STANDARD COMPETITION TERMS

The Promoter

Tickets 2 Treasure, contact details below, (‘Promoter’, ‘our(s)’) operates various competitions resulting in the allocation of prizes (‘Prize’ or ‘Prizes’) in accordance with these terms and conditions on the website www.tickets2treasure.com (the ‘Website’).

The Competitions

All draws operated by the Promoter on its Website to win Prizes are referred to respectively as the ‘Competition’ or ‘Competitions’ in these Terms and Conditions. This includes one-off Prize Competitions and instant win add-on prizes (‘Instant Win Prize’) within those Competitions.

Multiple Competitions may be operated at the same time by the Promoter and each Competition will have a specific Prize and may have Instant Win Prizes, all as set out in Clause 7 below. Availability and pricing of Competitions is at the discretion of the Promoter and will be specified on the Website. Each Competition has a free entry route available as well as a paid entry route. The availability of a free entry route to enter each Competition means that the Competition does not fall within the definition of a lottery under the Gambling Act 2005 and can be operated legally in Great Britain without any need for a licence.

Each Competition will run for the period specified. Please see the promotion on the Website for each Competition for details of start and end times and dates (‘Promotion Period(s)’). Each Competition will run for a period of time specified at the creation of each competition. The competitions will end when the timer runs out, and the competitions will never have time added on, however, the promoter can end competitions earlier at the promoter’s discretion.

Eligibility and Undertaking to Eligibility

Competitions are open to all persons aged 18 or over anywhere in the world, although employees of the Promoter or any person connected with the Promoter (through family, professional or commercial association) are prohibited from participating in Competitions.

By entering a Competition, the entrant (‘Entrant’, ‘you’, ‘your(s)’ and/or ‘Customer’) will be deemed to:

  • have the legal capacity to enter it;
  • have read, understood and accepted these Terms and Conditions; and
  • be bound by them and by any other requirements set out in any of the Promoter’s related promotional material on the Website.

By participating in a Competition either online via the Website or by postal entry, you hereby confirm that you are not breaching any laws in your country of residence regarding the legality of entering our Competitions. The Promoter will not be held responsible for any Entrant entering any of our Competitions unlawfully. If in any doubt you should immediately leave the Website and check with the relevant authorities in your country.

The Promoter reserves the right to refuse a Customer’s Entry at the Promoter’s own discretion. All Competitions are governed by English law and all and/or any matters or disputes relating to the Competition will be dealt with and/or resolved under English Law and the Courts of England shall have exclusive jurisdiction.

How To Enter

4.1 Creating an Account

To enter any Competition, you must first create an account on our Website. To register an account online, you will be asked to provide an email address or to sign in via a social media account, such as Facebook, Twitter, or Gmail. You must then either:

(i) Submit the online entry form provided on the Website; or
(ii) Send a postal entry to the Promoter. In both cases, the entries must be received by the end of the Promotion Period for the Competition as stated on the Website. All Entrants must confirm when registering that they have read and accepted these Terms and Conditions.

4.2 Contact Details

All Entrants must provide their contact details to the Promoter, including:

  • Full name
  • Date of birth
  • Email address
  • Postal address
  • Contact telephone number (‘Contact Details’).

The Contact Details will be used to confirm an Entry, to notify the Winner if they have won a Prize, to post the Winner’s name and location on the Website as a Winner unless requested otherwise by an Entrant under Clause 9.2, and in any other way set out in our Privacy Policy on the Website.

4.3 Online Entries

When playing a Competition online via the Website, you must follow the on-screen instructions to:

  • Select the Competition you wish to enter;
  • Purchase your ticket(s) to the Competition (‘Tickets’) and provide your Contact and payment details (‘Online Entry’).

Once your payment has cleared, we will contact you by email to confirm your entry into the Competition.

4.4 Postal Entries

Postal Entry is free. All Entrants must specify which Competition they wish to enter and provide their Contact Details to the Promoter by post to the following address:

First or second-class postage must be paid for each such Entry (‘Postal Entry’). Bulk entries (within the same envelope) will not be accepted. Postal entries will not be accepted directly through the letterbox. Only one Postal Entry is permitted per Competition for each registered account. Postal Entries are limited to one Entry per person to each Competition. Each Postal Entry has the same chance of winning a Prize or an Instant Win Prize as an Online Entry.

4.5 Entry Validity

All Entries, whether Online or Postal, must arrive by the end of the Promotion Period for a Competition as stated on the Website. If a Competition has sold out, then no further Entries will be accepted and the Website will state that that Competition has closed.

5.1 Winner Selection

Tickets 2 Treasure’s guaranteed 100% random number generator will determine the winner of each Competition’s Prize (‘Prize Winner(s)’). All numbers entered into the Competition are allocated randomly and securely. The result will be live-streamed on the Website or another platform, as stated by the Promoter.

5.2 Prize Confirmation

The Promoter will attempt to contact Winners using the Contact Details provided at the time of Entry. Winners must confirm acceptance of their Prize within five (5) working days. Failure to do so may result in forfeiture of the Prize.

Winner’s Responsibilities

6.1 Age Verification

Each Prize Winner will be required to show documentary proof of their age (18+) and identification prior to the receipt of a Prize. Failure to meet this requirement may result in disqualification.

6.2 Publicity Consent

Prize Winners agree to provide photographs and/or pose for promotional material in connection with the Competition unless stated otherwise.

Competition Prizes

7.1 Prize Details

Details of each Prize can be found on the Website. The Promoter takes no responsibility for the Prize awarded after delivery to the Prize Winner has taken place. Winners may elect to receive a cash alternative if offered by the Promoter.

7.1a Rollover Clause – Minimum Ticket Threshold

If fewer than 80% of the total available tickets for a Competition are sold by the time the timer ends, the draw will not take place at that time. Instead, the Competition will automatically roll over and continue until a minimum of 80% of the tickets have been sold. The rollover period will be communicated on the Website, and all previously purchased entries will remain valid for the extended duration. The Promoter reserves the right to adjust the closing time of the Competition in accordance with this rollover clause. No refunds will be issued as long as the Competition remains live and the prize remains unchanged.

7.2 Delivery

Delivery of the Prize to a UK address is free. Delivery to an address outside the UK may incur additional fees.

7.3 Taxes and Expenses

All expenses related to claiming the Prize, including taxes, are the sole responsibility of the Prize Winner.

7.4 Prize Conditions

The Prize Winner hereby agrees that all Prizes are subject to and are conditional on the terms and conditions of the Promoter, Prize provider, manufacturer and/or supplier and/or anyone that is involved in the provision or delivery of the Prize to the Prize Winner, as will be communicated to the Prize Winner prior to handover of the Prize.

7.5 Non-Transferable

Each Prize must, subject to Clause 7.6, be accepted as awarded and is non-transferable or convertible to other substitutes and cannot be used in conjunction with any other vouchers, offers or discounts, including without limitation any vouchers or offers of the Promoter or other Prize suppliers and/or third parties.

7.6 Cash Alternative

If the Promoter so offers, all Prize Winners have the option to elect to receive either the full Prize for the Competition or a cash alternative set by the Promoter which is reasonably equivalent to the Prize. The Prize Winner is under no obligation to accept the cash alternative and the full Prize as per the Competition’s details will be awarded unless a cash alternative is accepted. All expenses related to claiming the Prize, including taxes, are the sole responsibility of the Prize Winner.

Storage

8.1 The Promoter will store the selected Prize free of charge for up to 30 days after notifying the Prize Winner. At the end of this period, the Prize will be delivered to the Prize Winner. If the Prize requires storage beyond 30 days, the associated costs will be the sole responsibility of the Prize Winner. These reasonable costs must be paid to the Promoter before the Prize is handed over to the Prize Winner.

Winners’ Personal Data

9.1 With the Winner’s consent, the Promoter may request a photo or video of the Winner for promotional purposes, including Public Relations and Marketing.

9.2 Entrants will be asked to consent to the use of their name, address, photograph, or other likeness, as well as participation in publicity events, without additional compensation. Reasonable travel expenses may be reimbursed if approved in writing by the Promoter beforehand. Entrants have the right to withhold consent for any such uses of their personal information.

Limits of Liability

10.1 The Promoter does not make any guarantees, warranties, or assurances regarding the quality, suitability, or fitness for purpose of the Prizes or services provided. Liability is excluded for any loss or damage to persons or property, including consequential or economic loss, resulting from the Promoter’s actions or omissions in arranging or supplying goods or services, except in cases of death or personal injury caused by the Promoter’s negligence, fraudulent misrepresentation, or where liability cannot legally be excluded.

10.2 The Promoter’s maximum total liability to any Prize Winner is limited to the value of the Prize awarded to that Prize Winner.

10.3 The Promoter’s maximum total liability to any Entrant (who is not a Prize Winner) is limited to the amount they have paid to enter Competitions within the first 12 months of participation.

10.4 These terms and conditions do not affect your statutory rights, including the right to make claims where applicable.

Electronic Communications

The Promoter accepts no responsibility for incomplete, failed, or corrupted computer transmissions, or for issues related to hardware, software, internet connectivity, service provider actions, or human error. The Promoter will endeavour to ensure that the Prize is awarded to the correct Entrant. If a Prize is awarded in error due to technical failure or human error, the Promoter reserves the right to reclaim the Prize and reallocate it to the correct Entrant. Any incorrectly awarded Prize must be returned immediately at the Entrant’s expense, or its value reimbursed to the Promoter, at the Promoter’s discretion.

The Promoter will take reasonable steps to ensure its software and website function properly across modern internet, tablet, and mobile browsers. However, only the Ticket recorded in the Promoter’s system is deemed valid for Competition entry. The Promoter is not liable for entries affected by software malfunctions or other errors.

Data Protection Notice

Any personal data you provide to the Promoter, or that the Promoter obtains from a third party (e.g., a credit card company), will be processed in accordance with the Promoter’s Privacy Policy, as outlined on the Website. This data is used to manage the Competition and deliver Prizes where applicable.

To process, record, and use your personal data, the Promoter may disclose this information to:

  • Any credit card company whose details you provide.
  • Any individual or entity to whom the Promoter intends to transfer its rights and/or responsibilities under any agreement with you.
  • Any party to whom the Promoter intends to sell or transfer its business, in whole or part.
  • Comply with any legal or regulatory obligations in any jurisdiction.
  • Prevent, detect, or prosecute fraud or other criminal activities.

The Promoter may need to transfer your personal data outside the United Kingdom to fulfil these purposes. In such cases, the Promoter ensures that your data is adequately protected during the transfer process.

Validation

13.1 The Promoter reserves the right to withhold delivery of a Prize until the following conditions are satisfied:

  • The Prize Winner holds a validly registered Website account and complies with these terms and conditions.
  • All outstanding amounts owed by the Prize Winner to the Promoter have been paid in full.
  • The Prize Winner’s age and identity, as well as their entitlement to receive the Prize, have been verified to the Promoter’s satisfaction (including the provision of documentary evidence such as proof of age and identity).

13.2 Without prejudice to the above, the Promoter may:

  • Withhold or retrieve a Prize (or its value) if fraud is reasonably suspected in relation to the Competition.

13.3 The Promoter may, at its sole discretion, deliver a Prize to an authorised representative of the Prize Winner if sufficient legal authorisation, such as a power of attorney, is provided.

Your Account

14.1 Password Security

You must keep your account password secure and take all necessary precautions to prevent unauthorised access. Specifically:

  • Memorise your password and do not share it with anyone.
  • Avoid writing your password down or storing it in an easily accessible manner.
  • Destroy any communication regarding your password after reading it.
  • Choose a strong, unique password that is difficult to guess.
  • Ensure no one else uses your account while you are logged in.
  • Log out of your account when not in use.

14.2 Your password and login details must remain confidential and unique to your account. They should not be shared or used to grant access to others.

14.3 If you suspect or know that someone else has accessed your account or knows your password, you must notify the Promoter immediately.

14.4 If you forget your password, you can reset it by following the instructions on the Website, provided you supply the required security information.

14.5 The Promoter is not responsible for any consequences resulting from breaches of these security requirements.

Changes

The Promoter may update these terms and conditions periodically. The latest version will be posted on the Website and will take effect immediately upon publication. Continued use of the Website after the changes come into effect constitutes your acceptance of the revised terms.

The Promoter may also update the Website and Competitions to reflect changes in services, systems, user feedback, or other factors.

Unauthorised Use and Expiry of Debit Cards

16.1 If your debit card is used without permission and your bank requests a refund of the relevant amount, the Promoter may suspend your account pending investigation. The Promoter is not liable for chargebacks initiated by your bank.

16.2 If your debit card expires, the Promoter will make reasonable efforts to return funds to the card before expiry. If this is not possible, you must contact the Promoter to arrange an alternative refund method.

Payment Cancellations and Bank Chargebacks

If you dispute any payment, you must contact the Promoter immediately to resolve the issue. In the case of an unjustified chargeback:

  • You will owe the Promoter the fees for Competitions entered during the chargeback period.
  • Additional recovery costs, including legal fees, may be applied.
  • Unjustified chargebacks may result in account termination.

Use of the Website

18.1 The Website and Competitions are intended for personal, non-commercial use only.

18.2 You must not:

  • Transmit unlawful or objectionable content.
  • Introduce harmful content (e.g., viruses) to the Website or systems.
  • Engage in activities that impair system functionality, reputation, or user experience.
  • Authorise others to commit these acts.

18.3 You agree to indemnify the Promoter against any claims or losses arising from misuse of your account or the Website.

18.4 The Promoter does not guarantee that the Website will display correctly on all devices.

18.5 Intellectual property rights in the Website and Competitions belong to the Promoter. You must not copy or misuse any materials or trademarks.

18.6 Accessing Competitions or your account outside the UK is strictly prohibited.

18.7 You must not:

  • copy, disclose, transmit and/or otherwise make available and/or remove or change any material available on the Website,
  • reverse engineer or decompile (whether in whole or in part) any software used in connection with the Website and/or the provision of the Competitions (except to the extent expressly permitted by applicable law) and/or
  • remove, obscure and/or change any copyright, trademark or other intellectual property right notices in any material obtained from the Website and/or as a result of playing the Competitions.

18.8 You hereby agree that playing Competitions (as well as accessing and/or using your account) whilst located in any jurisdiction other than the United Kingdom is strictly prohibited.

Discretion

The exercise by the Promoter of any discretion provided for in these terms and conditions will be final and binding.

General Provisions

20.1 Failure to Enforce

If the Promoter fails or delays in enforcing any provision of these terms and conditions, such failure or delay shall not be deemed a waiver of the Promoter’s rights to enforce that provision at a later time.

20.2 Severability

Should any provision (or part thereof) of these terms and conditions be deemed void or unenforceable by a court of competent jurisdiction, this decision will affect only the specific provision (or part thereof) in question. All remaining provisions will continue to be valid and enforceable.

20.3 Assignment and Transfer

You are not permitted to assign or transfer any of your rights or obligations under these terms and conditions, either in whole or in part. Any breach of this rule may result in the suspension or termination of your account, access to the Website, and/or participation in the Competition.

The Promoter reserves the right to assign or transfer its rights and/or obligations under these terms and conditions, either in whole or in part, to any third party without your consent. Additionally, the Promoter may assign these terms and conditions in their entirety to its successor, such as in the event of a merger, reorganisation, or sale of assets. These terms and conditions will remain binding and enforceable for the Promoter, its successors, and permitted assigns.

20.4 Entire Agreement

These terms and conditions constitute the entire agreement between you and the Promoter concerning the subject matter. They replace and supersede all prior or contemporaneous agreements, terms, and conditions related to the same subject matter.

20.5 Third-Party Rights

No individual or entity that is not a party to these terms and conditions has the right to enforce any provision under the Contracts (Rights of Third Parties) Act 1999 (as amended or re-enacted) or any similar legislation.

20.6 Force Majeure

The Promoter is not liable for any delay or failure to perform its obligations under these terms and conditions due to causes beyond its reasonable control. These causes include, but are not limited to, acts of God, industrial disputes, power outages, network failures, natural disasters, governmental actions, acts of terrorism, riots, or war.

20.7 Hyperlinks to Third-Party Websites

The Website may include hyperlinks to external websites operated by third parties. These links are provided solely for your convenience and reference. The Promoter has no control over these websites and accepts no responsibility for their content, privacy practices, or other policies.

You are responsible for ensuring any linked content or downloaded software is free from viruses or other harmful elements.

The inclusion of any hyperlinks does not imply endorsement, association, sponsorship, or partnership between the Promoter and the linked websites or their operators.

You must not create a hyperlink to the Promoter’s Website without prior written consent.

General Terms

Liability

The Promoter will not be held liable for any losses incurred as a result of entering the Competitions. The Promoter’s total liability is limited to the value of the Prize awarded.
